Obligation for employers to update and register the data regarding all current employment agreements within Social Security until the 31st of December, 2022

CTSU – A Deloitte Legal Practice informs that, until the 31st of December, 2022, all employers are obliged to update and register the data regarding all current employment agreements.

Communication of employees’ admission and changes to and termination of employment agreements

All employers are obliged to communicate to the Social Security Services (i) the admission of employees, (ii) the alteration of the employment agreement’s modality and (iii) the suspension and termination (and its respective cause) of the employment agreement.
On the 1st of April, 2022, Social Security has implemented a new online tool for employers to comply with all three communication obligations mentioned above, which is available at the Social Security Direct website.

 

Additional information

This new feature entails that employers are now required to submit further information as to the admission of employees, changes to employment agreements and the suspension or termination of employment agreements. In fact, further to the usual data disclosed, employers should now also reveal:

  • Provision of work (on site or under a remote work regime);
  • Profession (according to the Portuguese Profession Classification List);
  • Base remuneration (monthly gross remuneration);
  • Percentage of work (as per the full time normal weekly period; part-time employment agreements mandatorily imply the fulfilling of this section);
  • Working hours (weekly working hours; for full time intermittent employment agreements, the annual number of hours of work should be disclosed and, for part-time employment agreements, this section must always be fulfilled);
  • Days of work (number of days of work per month; for full time intermittent employment agreements, the annual number of days of work should be disclosed and, for part-time employment agreements, this section must always be fulfilled);
  • Payments due to seniority (optional);
  • Modality of the employment agreement, ie. permanent, fixed-term or unfixed-term (this section should be fulfilled upon admission and whenever any changes on the employment agreement occur).

 

Update and registry of data until the 31st of December, 2022

Following the implementation of this new tool, all employers will be required to update and register, until the 31st of December, 2022, all data regarding their currently active employment agreements, on the Social Security Direct platform.
This new service can be reached by, upon signing in on the Social Security Direct, following the steps “menu Emprego” and then “Vínculos de Trabalhadores”.
