Extension of the exceptional regime applicable to protect tenants

On the September 30th, 2020, Law no. 58-A/2020, was published in the Portuguese Official Gazette, which extends the extraordinary regime of protection for tenants provided for in article 8, of Law no. 1-A/2020, of March 19th.
Therefore, until December 31st, 2020, and no longer until September 30th, 2020, is suspended:
i. The effects of the landlord’s reports of residential and non-residential lease agreements;
ii. Forfeiture of residential and non-residential lease agreements, unless the tenant does not object to it;
iii. The effects of the revocation, the opposition to the renewal of residential and non-residential lease agreements when made by the landlord;
iv. The period indicated in article 1053º, of the Civil Code, if the end of this period occurs during the period of time in which said measures are in force;
v. The foreclosure of a mortgage on a property that constitutes the own permanent residence.
However, the above mentioned suspension will now depend, regarding the rents due from October to December, on their regular payment, with the exception of non-residential tenants who benefit from the moratorium regime provided by Law no. 4-C/2020, of April 6th, in its current version.
Lastly, the Law under analysis establishes a new deadline, until December 31st, 2020, so that once the respective requirements have been verified, applications can be submitted for loans from the Institute of Housing and Urban Rehabilitation, I. P.
The present Law took effect at midnight of October 1st, 2020.
