Legal Alert no. 79 – Average building value per square meter set for 2019

The Decree no. 330-A/2018, published in the Official Gazette of the Republic of Portugal on 20th December, sets the average building value per square meter applicable in 2019.


The Decree no. 330-A/2018 sets € 492.00 as the average building value per square meter in 2019, for the purposes of article 39 of the Municipal Property Tax Code (cfr. article 1 of the Decree no. 330-A/2018). This Decree is applicable to all the urban buildings whose Declaration Form 1 is submitted as of the 1st January 2019 (cfr. article 1 of the Decree no. 330-A/2018).


The average building value per square meter, set annually, is one of the objective indicators used in the calculation formula of the urban buildings’ tax value (cfr. Articles 38 and 39 of the Municipal Property Tax Code).


The average building value per square meter set at € 492,00 by the Decree no. 330-A/2018 for 2019 represents an increase over the previous year, which was € 482,40. Therefore, the base value of urban buildings, which is calculated on the basis of the average building value per square meter, will increase over the previous year and, consequently, the urban buildings’ tax value will also increase. The increase of these factors will most likely result in an increase of the Municipal Property Tax and the Municipal Tax on Real Estate Transactions paid with reference to urban buildings.
