Ministerial Order no. 111/2018, dated from April 26th

On April 26th, it was published, in the Portuguese Official Gazette, the Ministerial Order no. 111/2018 with the purpose of defining the conditions and the requirements of the home delivery, through the internet, of medicinal products and of other health technologies reimbursed by the State. Thus, this Ministerial Order amends the provisions of Ministerial Orders (i) no. 1427/2007, dated from November 2nd, (ii) no. 284/2016, dated from November 4th, amended by the Ministerial Order no. 92-F/2017, dated from March 3rd, and (iii) no. 92-E/2017, dated from March 3rd.

In this regard, the regime of the Ministerial Order no. 1427, dated from November 2nd, which settles the conditions and requirements of the home delivery of medicinal products through the Internet, becomes also applicable, with the necessary adaptations, to the home delivery and/or through the Internet of other health technologies.

The Ministerial Order no. 284/2016, dated from November 4th, which establishes the regime of the reimbursement of medical devices to support ostomated patients, aimed to beneficiaries of the National Health System (NHS), and the Ministerial Order no. 92-E/2017, dated from March 3rd, which establishes the regime of reimbursement of the State in the price of medical devices to support patients with urinary incontinence or retention, aimed to beneficiaries of the NHS, will both also be applicable to the beneficiaries of other public subsystems. Additionally, it is set forth that the medical devices covered by each of these two Ministerial Orders may solely be prescribed at the NHS establishments and by NHS’s physicians, and supplied at dispensing pharmacies.

This Ministerial Order entered into force on May 1st.
