Legal Alert no. 53 – Reimbursement of the civil protection municipal fee imposed by Lisbon City Hall

Further to the declaration of unconstitutionality of the civil protection municipal fee imposed by Lisbon City Hall, the amounts unduly charged between 2015 and 2017 will be reimbursed as of the second fortnight of February. However, it should be noted that, despite the controversy, the refund will not include interest.

In the majority of cases, the reimbursement will take place by mail through a postal order and will only require withdrawing the amounts unduly charged in the post office or depositing those amounts in the taxpayer’s bank account. Nonetheless, the refund by mail will not be automatic for all taxpayers as it may run into problems due to various circumstances (e.g. mail loss, changes of address, deaths).

The reimbursement process will be different in what regards taxpayers with residence abroad and taxpayers that will have a refund higher than € 5,000, whom will be contacted by the Lisbon City Hall and will be payed by bank transfer. The taxpayers that are in debt with the Lisbon City Hall will also be contacted in order to do a settlement of scores.
