Decree-Law No. 149/2019, of October 9th, which establishes the reinforcement of the mechanisms for publicizing the procedures for identifying and recognizing rustic or mixed buildings without known owner

 

On October 9th, 2019, was published in the Portuguese Official Gazette the Decree-Law No. 149/2019, which makes the first amendment of Decree-Law No. 15/2019, of January 21st, 2019, establishing the reinforcement of the mechanics for publicizing and recognizing rustic or mixed buildings without known owner.

The amendment provided in said Decree-Law No. 149/2019 aims to strengthen citizens’ assurance of access to information and knowledge of the existence of a specific regime for the identification, recognition and registration of rustic or mixed buildings without known owner, through its wide dissemination and publicity.

The Registries and Notaries Institute (“Instituto dos Registos e Notariado , I.P.”), promotes the advertising of the building identified as a building without known owner, through advertisements published in regional edited newspapers or distributed in the municipality area of ​​the building, in addition to the forms of advertising previously provided.

The IRN, I.P. is also the entity responsible for promoting the publicity of the building without known owner that has been provisionally registered in favor of the Portuguese State, which can be done through BUPi (“Balcão Único do Prédio”), within 30 days of the provisional registration, or by means of a notice to be posted at the headquarters of the respective municipality and parish of the situation of the building, for a period of 180 days counting from the provisional registration.

In light of the above, it is also foreseen that the Tax and Customs Authority will inform the owners of registered rustic or mixed buildings of the existence of the procedure established by said Decree-Law, containing information regarding the terms of identification, recognition and registration of rustic or mixed buildings without known owner and the constitutive acts of rights that deriving from them in favor of the Portuguese State.
